Both Houses Of Congress Are Violating Their Oath Of Office

The recent years since 9/11 have proven our elected representatives have little to no interest in presenting or passing legislation that passes constitutional muster. A myriad of laws such as Patriot Act, GM takeover, NDAA, Bankster bailouts, Operating government without formal budget, mandated Healthcare and coming legislative assaults on second amendment all point to an out of control tyrannical government our founders never intended but clearly warned us about.

The oath of office is now treated as just words to be said but no one holds those taking the oath responsible. Violating the oath is codified as a violation of federal law and executive order.

The oath taken by both houses of Congress reads,

I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter: So help me God.

It is apparent that the section of the oath that seems almost daily violated by politicians is “I will bear true faith and allegiance to the same; that I take this obligation freely, without reservation or purpose of evasion;”

The congress as a whole along with the executive branch has been knowingly presenting legislation contrary to the constitution and then relying on legal challenges to make it to supreme court for final disposition, that folks is still a violation of the oath taken no matter the lawyeristic maneuver of passing legislation as constitutional and waiting for a challenge. If these were your children you would immediately scold for exceeding limits by their hope of getting away with trouble but suffering consequences for only the most egregious just by sheer quantity, its evasive both by congress and by children, both should be accountable.

Federal law regulating oath of office by government officials is divided into four parts along with an executive order which further defines the law for purposes of enforcement. 5 U.S.C. 3331, provides the text of the actual oath of office members of Congress are required to take before assuming office. 5 U.S.C. 3333 requires members of Congress sign an affidavit that they have taken the oath of office required by 5 U.S.C. 3331 and have not or will not violate that oath of office during their tenure of office as defined by the third part of the law, 5 U.S.C. 7311 which explicitly makes it a federal criminal offense (and a violation of oath of office) for anyone employed in the United States Government (including members of Congress) to “advocate the overthrow of our constitutional form of government”. The fourth federal law, 18 U.S.C. 1918 provides penalties for violation of oath office described in 5 U.S.C. 7311 which include: (1) removal from office and; (2) confinement or a fine.

The definition of “advocate” is further specified in Executive Order 10450 which for the purposes of enforcement supplements 5 U.S.C. 7311. One provision of Executive Order 10450 specifies it is a violation of 5 U.S.C. 7311 for any person taking the oath of office to advocate “the alteration … of the form of the government of the United States by unconstitutional means.” Our form of government is defined by the Constitution of the United States. It can only be “altered” by constitutional amendment. Thus, according to Executive Order 10450 (and therefore 5 U.S. 7311) any act taken by government officials who have taken the oath of office prescribed by 5 U.S.C. 3331 which alters the form of government other by amendment, is a criminal violation of the 5 U.S.C. 7311.

Violating Oath

The question is, “why do the American people allow their representatives to break oath of office (a federal crime) and not hold them accountable?

This should be a non-partisan subject simply due to the fact this has been going on for long decades and both parties are guilty according to the law.

Anyone that is paying attention has watched a slow and steady deterioration of personal freedoms, and it’s about to reach a tipping point where those hard fought rights become meaningless.

Simple said, it doesn’t take a genius to see we’re traveling at breakneck speed down a road towards tyranny. The scales could be tipped back somewhat if the public voiced expectation that the oath be taken seriously. On the other hand, the alternative might eventually come to past in the words of Thomas Jefferson, “The tree of liberty must be refreshed from time to time with the blood of patriots and tyrants.”

  1. Those in elected positions in Washington D.C., seem unwilling to listen to their constituents, so I believe the option suggested by Thomas Jefferson, may be the only realistic one!

  5. alas, more than enough evidence to prove these allegations. BOTH houses are corrupt and both parties have corrupt people in them but the DNC is by far and way the worst as it has become the new communist party and given up any semblance of honesty, decency, or patriotism.

  6. Our Constitution should not be violated ever !! 🇺🇸🇺🇸🇺🇸 Any member including Presidents should face severe punishment. No ifs or buts. Not knowing the rules is not to be used for any exuse. Must select non partisan entities as arbitrsters. Not like the Supreme Court as it is now. After 250 years this should have been solved a long time ago. Our Constitution is not a living breathing entities . It is in BLACK AND WHITE FOR ALL TO READ. If someone can not comprehend it should not be serving in any position ever. As for me, I firmly believe that We, The People of This Great Nation, The People, should Honor Our Motto (In God We Trust) as the Principles of Biblical Truth is a guide to moral, and healthy living! It has nothing to do with separation of church and state! It has to do with Truth, Morality, Justice, Equality,and all other healthy virtues irregardless of color or creed. If We, as a People, do not address the problem at its core, there isn’t much left to do! All the laws and legislation’s cannot fix this simple truth.

  9. So, why are those who are able to do so, not challenging this law-breaking authority at all levels, every time it is violated? Why are we not in Congressional Districts with Ads, etc., working to educate a just plain stupid populace on what is going on? Lying is a crime, and Congress, especially the Democrats, do it every day.

  10. I have emailed, written and called my elected Congressional representatives. Calls went straight to an answering machine (and the delete button I’m sure), only 1 email received a canned response. I am thoroughly disgusted and have, for the 1st time in my life, become angry at both parties, neither of which represent Americans anymore. The oath of office has teeth and we need to hold Congress accountable for working against the Constitution!

  11. We need to clean out our Government,We can start by throwing out the Muslims Neither likes America,Our people,our customs ,or anything about us. So why are they in our government? they are the first step of the take over of America to become a Muslim Nation. We need to get them out of our governing Body. Once Americans are back in command We can Clean up Washington and drain the swamp.
